Terms and Conditions
1. General
All goods sold and all orders taken are subject to these conditions. Contracts for the supply of goods or services to retail or domestic customers are governed by The Sale of Goods Act 1979 (as amended) and supplied in compliance with, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, (CCICAR). Any customers contacting in the course of their business are excluded from consumer protection legislation and are contacting with the company on a business to business basis.
2. Price and Payment
a) All prices quoted by Turfshop include the cost of delivery unless otherwise stated.
b) Customers are required to pay by credit card/debit card at the time of ordering.
c) Prices quoted are all inclusive and delivered unless otherwise stated.
3. Delivery
a) Turfshop will make every effort to deliver turf on the agreed date. If for any reason Turfshop is unable to deliver then no liability whether in damages or otherwise for delay of whole or any part of the goods ordered arising from any cause will be accepted.
b) Delivery by Turfshop shall be conditional upon access free from encumbrances and good roads being available to the haulage company's vehicles to the place of delivery. The company reserves the right to cancel or hold any orders that the company deems may suffer from potential delivery problems and as a result, delivery dates may be delayed.
c) If Turfshop cannot gain access to the delivery address then additional costs may be incurred. Deliveries are made using large vehicles, typically 18 tonne wagons, and it is the customers responsibility to inform Turfshop if there may be an access problem. In such cases that delivery, in the opinion of Turfshop is not possible, then the company reserves the right to cancel the order. The company must be informed of any possible access problems before the goods have been dispatched.
d) Delivery vehicles use tail lift offloading, and it must be emphasised that the delivery vehicle must be able to park in the area where the delivery is to be made. A pallet truck is then used to manoeuvre the goods off the tail lift to the kerbside delivery point. The customer, or somebody appointed by the customer, should be at the delivery point to accept the delivery. The delivery drivers are only contracted to deliver the goods to the kerbside. The goods will be palletised and net wrapped.
e) The kerbside delivery point must be flat and hardstanding. We cannot deliver to hills, slopes, inclines or gravel. If you have any concerns over the delivery you must contact Turfshop before the goods have been dispatched.
f) Whilst every effort will be made to carry out any delivery instructions passed on, this is not always possible. Any instructions left for delivery are at the discretion of the driver and do not waive the standard kerbside terms and conditions.
g) Turfshop will endeavour at all times to deliver goods ordered within a reasonable time. Where, however, due to circumstances beyond Turfshop’s control, delivery is delayed, Turfshop will not be liable for any damages resulting. If for any reason Turfshop is unable to make delivery of the whole of the amount ordered, the terms and conditions here set out will still apply to the part of the order completed, as they would have applied to the whole.
h) Any shortfall in the quantity delivered, or damages to the product, must be written on the delivery note at the time of delivery. When signing for the goods you are agreeing they have been received in full and in good order. We cannot offer any refunds or replacements without this. It is at your own risk if you are not at the property to receive and check the goods.
i) Turfshop company will not accept any liability for damages to property caused during delivery.
j) Any additional charges incurred during delivery (i.e. parking charges, etc) will be at the liability of the customer.
6. Cancellation
Orders may be cancelled 2 working days prior to the arranged delivery date. Cancellation requests should be emailed to [email protected].
7. Order Amendments
Orders may be amended 2 working days prior to the arranged delivery date. Amendment requests should be emailed to [email protected]. Once dispatched, goods which are liable to deteriorate or expire rapidly are excluded from cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCICAR). Cancellation of non-perishable goods after dispatch will be subject to return charges.
8. Returns Policy
a) After delivery the customer has the right to cancel and return any product except perishable goods which are listed in sub point d below. Any return request must be made within 7 days from the date of the delivery.
b) Return requests should be made by emailing [email protected].
c) Customers are required to return the goods, at their own expense, to Turfshop, Springwood Farm, Drinsey Nook Lane, Thorney, Newark, Nottinghamshire, NG23 7DR without undue delay and in any event not later than 14 days after the return request is accepted.
d) Perishable goods are Turf and other living products. Perishable goods are excluded from our returns policy under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, (CCICAR). All other goods are non-perishable.
9. Exclusion of Liability
a) Once a customer has accepted goods supplied by Turfshop, Turfshop will have no further liability for the goods or for any damages connected with their use. A customer will be deemed to have accepted the goods unless, within 3 days of delivery, Turfshop has been informed by email of any alleged defect. In any event, the limit of Turfshop’ liability will be to replace the defective goods (subject to 8.b. below) and will not extend to consequential damage, expenses or loss of any other kind.
b) Turfshop will not be responsible for any defects in the goods arising from improper treatment, laying or maintenance by the customer.
c) Notwithstanding 2 above, any liability arising to third parties or other risk in respect of goods sold will be for the customer’s account after delivery.
10. Product Specification
a) Turf is a natural product and Turfshop cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. Natural products may show some colour variations.
b) As turf is classed as a product which is liable to deteriorate or expire rapidly (CCICAR 2013), if the customer is dissatisfied with the product we ask that photos of the turf are emailed to us as soon as possible after delivery [email protected].
c) Any advice and information given by Turfshop relating to the characteristics and suitability of its goods for particular application is for guidance only and accordingly no warranty in this regard is given, whether express or implied. Customers should satisfy themselves that any turf ordered is suitable for its intended use, and they are welcome to inspect the growing turf at Turfshop’ nurseries for this purpose.
d) Turfshop reserve the right to alter the mixture of seed used to produce turf without notice. A change, which does not materially affect the suitability of the turf for its specified use, shall not constitute grounds for any claim by the customer.
e) Sizes, weights and measures quoted for goods may vary due to the nature of the product.
11. Annual Meadow Grass
Whilst the Company takes every care to ensure that the presence of Poa Annua (annual meadowgrass) is kept to a minimum, the Company does not guarantee that any turf is free of this grass species on delivery, either post or pre-emergent.
The above excludes our Poa Annua / Bent greens turf, where the Poa Annua forms an integral part of the sward.
12. Pests
Whilst the Company takes every care to control the presence of pests, most notably Chafer species, Cranefly Larvae (Leatherjackets), Bibionid Fly Larvae, Earthworms and Nematodes, the Company cannot guarantee that any turf is free from these pests in any form upon delivery.
13. Diseases
Whilst the Company takes every care to control the presence of turf and soil borne diseases, the company cannot guarantee that any turf is free of disease pathogens upon delivery.
14. Wildflower Turf
a) All photos displayed on our website are for illustrative purposes only, and therefore may not be representative of the customers own site-specific establishment of the wildflower turf purchased.
b) Whilst the Company takes every care to avoid the presence of other wildflower or grass species within any wildflower turf products, the company cannot guarantee the turf free from their presence, in either seed or germinated form on delivery.
c) All wildflower Turf varieties will establish differently depending on location, soil type, environmental conditions and ongoing maintenance. The Company cannot guarantee the establishment or sustainability of all species within any specific mix.
d) The Company cannot accept liability for the loss of plant composition due to the dominance of an individual plant species.
e) All species compositions for all wildflower products on our website are for guidance purposes only. The Company reserves the right to change species composition without notice.

g) Customers should satisfy themselves that any wildflower turf ordered is suitable for its intended use, and they are welcome to inspect the growing wildflower turf at Turfshop’ nurseries for this purpose.
15. Installation of Turf
The condition of all turf can deteriorate when rolled up, particularly during periods of warm weather. Turfshop advise that all turf should be laid immediately on the day of delivery. We advise resourcing sufficient labour to achieve this and that site preparation is complete to avoid any delay. If this is not going to be possible then Turfshop advise that all turf is rolled out, grass side up, in a cool, dry area and watered if necessary prior to laying. Turfshop will not be held liable for any deterioration in turf condition beyond the day of delivery.

Working days are Monday, Tuesday, Wednesday, Thursday and Friday.
